Understanding the billing structures for attorneys in China is essential for both clients and legal practitioners to ensure transparency and avoid unexpected costs. Chinese law firms employ a variety of billing methods, including hourly fees, fixed fees, contingency fees, and hybrid models, which combine different fee types. For instance, while hourly billing is more prevalent among foreign clients (70-80%), domestic clients often prefer fixed or project-based fees, which remain the mainstream billing arrangements in China's legal market.
Hourly rates for legal advice typically range from USD 200 to USD 500, with variations based on the seniority of the lawyer. In 2020, the average hourly rate was approximately RMB 2,909 (or US$445), but this can range from RMB 1,200 for junior lawyers to RMB 10,000 for senior partners. Meanwhile, contingency fees are regulated, with new rules implemented in March 2022 prohibiting these in certain case types and capping the percentage at 6% for claims over 50 million CNY, a reduction from the previous 30% limit.
