In Portugal, the legal landscape mandates stringent time-tracking requirements under Article 202 of the Portuguese Labour Code. Companies are required to meticulously record employee working hours, breaks, and absences to comply with regulations. This applies to nearly all businesses, regardless of sector or size, and includes employees on fixed schedules, flexible hours, and even remote workers. Exceptions are rare and typically apply only to senior staff with full autonomy.
To remain compliant, businesses must ensure their timesheets include start and end times for each work period, effective hours worked, and overtime details. These records must be reliable, accessible to both employees and the Labour Authority (ACT), and retained for at least five years. The standard workweek in Portugal is 40 hours, with a maximum of 48 hours when including overtime.
