Calculating overtime pay in Japan requires understanding the Labor Standards Act, which defines standard working hours as 8 hours per day and 40 hours per week. Overtime, known as "Zangyo," is any work beyond these limits. To legally require overtime, employers must have an "Article 36 Agreement" with a labor union or employee representative. This agreement, renewed annually, ensures compliance with Japanese labor laws.
Overtime pay rates vary significantly. For regular overtime, a minimum of 25% above the normal wage is typical. Late-night work, between 10 PM and 5 AM, incurs an additional 25% premium. Overtime exceeding 60 hours in a month requires a 50% premium, effective for all businesses from April 1, 2023. Work on statutory holidays is compensated at 35% above the normal rate. These combined rates can lead to premiums of 50% to 75% for certain scenarios, such as late-night holiday work.
