Understanding Time Tracking Requirements in Germany
Since September 13, 2022, it has been mandatory for employers in Germany to record the full working hours of their employees. This requirement is grounded in the German Federal Labour Court's ruling, aligning with the European Court of Justice's directive from 2019. Under the Arbeitszeitgesetz (Working Time Act), employees cannot work more than 8 hours daily, although this can extend to 10 hours provided the average remains at 8 hours over six months or 24 weeks.
To comply with these regulations, employers must also ensure employees take minimum breaks of 30 minutes for days exceeding 6 hours, and 45 minutes for days exceeding 9 hours. These breaks can be segmented into 15-minute intervals. Importantly, a continuous rest period of 11 hours is required between workdays. Non-compliance can result in fines up to EUR 30,000, emphasizing the critical need for precise time tracking solutions.
