Understanding Virginia's Overtime Laws: VOWA and FLSA
Virginia's overtime regulations are governed by the Virginia Overtime Wage Act (VOWA) and the federal Fair Labor Standards Act (FLSA), both of which mandate that non-exempt employees receive overtime pay for hours worked beyond 40 in a single workweek. Unlike some states, Virginia does not require overtime for daily hours or double-time pay. The overtime pay is calculated at one and one-half times (1.5x) the employee's regular rate of pay. This ensures employees are fairly compensated for extra work hours.
As of January 1, 2025, the minimum wage in Virginia will be $12.41 per hour, which will increase to $12.77 per hour in 2026. Consequently, the minimum overtime pay rate will be $19.16 per hour for those earning minimum wage. It's crucial to note that the regular rate of pay includes all non-overtime earnings such as shift differentials and non-discretionary bonuses, which aligns with both VOWA and FLSA standards.
