Slovak employers are legally required to maintain verifiable records of employee working hours, including regular hours, overtime, and on-call time, as mandated by the Slovak Labour Code (Act No. 311/2001 Coll.). This aligns with the European Court of Justice's 2019 ruling, which enforces an "objective, reliable, and accessible system" for tracking daily working time across the EU from July 2024. Standard working hours in Slovakia are 40 hours per week, with a maximum of 48 hours when overtime is included, averaged over a reference period of up to 12 months if agreed upon by employee representatives.
Employers can require up to 150 hours of overtime annually, extendable to 400 hours with consent. Overtime compensation includes a minimum 25% wage premium. Night work, performed between 10 PM and 6 AM, requires a 20% surcharge. Compliance with these rules is crucial, as non-compliance can lead to fines up to €200,000. Records must be kept for at least 5 years to ensure accountability and prevent labor violations.
