According to the Manpower Law No. 13 of 2003, overtime is defined as any work performed beyond the standard 40-hour workweek. This can be structured as either 7 hours a day for 6 days or 8 hours a day for 5 days. Additionally, work performed on rest days or public holidays qualifies as overtime. Government Regulation No. 35 of 2021 further mandates that employers must issue written orders for overtime and obtain prior consent from employees. Failure to comply can result in fines ranging from Rp 5,000,000 to Rp 50,000,000.
Furthermore, the Minister of Manpower and Transmigration Decree No. KEP.102/MEN/VI/2004 outlines employer obligations, including providing adequate rest periods and meals for overtime extending 4 hours or more.
