The Evolving Landscape of Time Tracking in Spain
Since the approval of Royal Decree-Law 8/2019, time tracking in Spain has become a legal necessity for all businesses. This regulation mandates that companies implement a system to record the daily working hours of every employee, regardless of their contract type. This law aims to prevent labor exploitation, monitor unpaid overtime, and ensure compliance with working hours and rest periods. Failure to adhere can result in fines ranging from €625 to €187,515, increasing to €1,000 to €10,000 per affected worker under proposed reforms. By 2026, all time tracking must be digital, eliminating paper timesheets.
The upcoming digital mandate further stresses the need for systems that are digital, tamper-resistant, and accessible. Companies are required to retain records for at least four years, ensuring they are available to employees, worker representatives, and the Labour Inspectorate.
